Appellant Carolyn Gordon serves as the class representative of Taekwon Do lesson purchasers who prevailed in a state court default judgment against the providers of karate services for breach of contract and numerous intentional torts. Gordon subsequently sued the providers’ insurer in state court in order to collect the judgment. Gordon sought a declaratory judgment entitling the class to payment as a third-party beneficiary of the insurance, as well as recovery for violation of the common law duty of good faith and fair dealing, breach of contract, and other related claims.
