Error to a judgment of the Circuit Court of the city of Biclimond, rendered December 7, 1897,’in an action of trespass on the case wherein the plaintiff in' error ivas the plaintiff, and the defendant in error ivas the defendant.

This cause was heard at a former term of the court, and an *508opinion and judgment rendered reversing the judgment complained of. Hpon a petition to rehear, that, judgment was set aside, and at this term of the court the cause was again argued and submitted.
