This is an appeal by the defendant below from a judgment of $7,500 in favor of the plaintiff, Mrs. Dorothy Gibbs Johnston, for the unlawful death of her husband, Thomas Jefferson Johnston.

Plaintiff-in-error has made eight Assignments of Error. Assignment of Error #1 is directed to the action of the Trial Court in refusing to sustain the defendant’s Motion for a Directed Verdict at the conclusion of all the proof. Therefore, we will discuss first the evidence as presented:
