The premises occupied by the plaintiff as a restaurant were damaged by water from a broken water main installed in the street by the city of New York and maintained by it. The break in the water main was discovered in the evening of April 12, 1938. There was a longitudinal split in the “ flange part ” of the main. The plaintiff produced evidence intended to show that the city failed to shut off the water from the broken water main within a reasonable time after it received notice of the break.
