This is a personal injury action under the Oregon Employers’ Liability Act in which the court set aside a verdict for the plaintiff and entered judgment for the defendant notwithstanding the verdict. The plaintiff has appealed. The action of the trial court was based upon the view that plaintiff’s sole remedy is under the Longshoremen’s and Harbor Workers’ Compensation Act (33 USC, Title 33, §§ 901 et seq.). This ruling presents the only question on this appeal.
