MEMORANDUM AND ORDER
SIFTON, Senior District Judge.
The United States brings this action for injunction against defendants Blue Ribbon Smoked Fish, Inc. (“Blue Ribbon”), Jay A. Suttenberg (“Suttenberg”), Pablo Negron (“Negron”), and Susan Dozortsev (“Do-zortsev”) (collectively, the “defendants”) under 21 U.S.C. § 332(a), the Federal Food, Drug and Cosmetic Act (the “Act” or “FDCA”).
