In this employment discrimination action, the defendants have made a motion for summary judgment pursuant to Rule 56, Fed.R.Civ.P., on the following grounds: (1) that the claims interposed under 42 U.S.C. §§ 1981, 1983 were not filed within the applicable period of limitation; (2) that the claims under 42 U.S.C. § 2000e-5 are barred for failure to make a timely complaint to the Equal Employment Opportunity Commission; (3) that because the defendants are not persons within the meaning of 42 U.S.C. § 1983, the court lacks jurisdiction under 28 U.S.C. § 1343 as to claims…
