OVERVIEW

In this diversity case, the Appellant, Lewis Eisenberg, has asserted three claims against his former employer, the Insurance Company of North America (“ICNA”). Specifically, the Appellant has charged that by terminating his employment, ICNA has 1) breached an oral employment contract; 2) breached the implied covenant of good faith and fair dealing; and 3) tortiously inflicted emotional distress.
