In an action to recover damages for personal injuries, the defendant appeals, as limited by its brief, from so much of a judgment of the Supreme Court, Queens County (Posner, J.), entered May 7, 1987, as, upon a jury verdict, was in favor of the plaintiff on the issue of liability.
Ordered that the judgment is reversed insofar as appealed from, on the law and as a matter of discretion in the interest of justice, and a new trial is granted on the issue of liability, with costs to abide the event.
