Appellant, Ronnie Duane Mason, was convicted of capital murder and sentenced to life imprisonment. At a pretrial hearing, defense counsel requested the grand jury testimony of Anthony Richards, Appellant’s cousin. Upon receiving the testi*253mony more than a year later, defense counsel saw that unauthorized persons had questioned Richards during the grand jury proceedings.
