On August 7, 1979, Thomas Allen Smith filed a voluntary petition in bankruptcy. On September 25th, Nationwide Financial Corporation of Colorado filed a complaint alleging that Smith’s debt to it is nondis-chargeable since it was obtained on the basis of a materially false financial statement in writing upon which the plaintiff relied, thus falling under the exception to discharge enunciated by § 17(a)(2) of the Bankruptcy Act, 11 U.S.C. § 35(a)(2).
