In this cause we consider the purported liability of a corporate entity, Tarmac Texas, Inc., which was never joined as a party in the lawsuit. After an industrial accident, Wal lace Bailey, Jr. sued Vanseot Concrete Company. The trial court rendered judgment in favor of Bailey against Vanseot Concrete Company d/b/a Express-Pennington. The court of appeals reversed the judgment against Vanseot and rendered judgment that Bailey take nothing. 862 S.W.2d 781. For the reasons explained herein, we affirm the judgment of the court of appeals.
