This is an appeal from a judgment convicting the defendant of the crime of burglary. The sole question presented for decision is the sufficiency of the indictment, the charging part of which reads as follows:

“The said Tom Tovrea on the 9th day of April, A. D. 1926, in the County of Wallowa, and State of Oregon then aiid there being, did then and there willfully, unlawfully and feloniously break and enter a certain building, to-wit, a garage in Joseph, in the County and State aforesaid, the same being then and there a building in which there was property kept at the time, with the intent of…
