This matter is before the Court on motions to dismiss filed by nominal defendant Keithley Instruments, Inc. (“KEI”) (Doc. No. 79), and by the individual defendants Brian Bachman, James Bartlett, Philip Estler, James Griswold, Hermann Hamm, Leon Hendrix, Frederick Hume, Joseph Keithley, David Patricy, John Pesec, Mark Plush, Ronald Rebner, N.
