ERVIN, Circuit Judge:
Having before us for review the convictions of Larry Roger Chinchic (under 18 U.S.C. §§ 2314 and 2) and Nick Melia (under 18 U.S.C. § 2315), we reverse and remand for new trials for reasons set out below.

A. History of the proceedings
In March 1980, Larry Roger Chinchic, Alfred Anthony Conti, Nick Melia and others were charged in a three count indictment issued following an FBI investigation of certain burglaries that had taken place in Wilmington, North Carolina, in April and May 1977.1 Chinchic and Conti were charged in the first count with interstate transportation of…
