ADAMS, J., took no part in the decision of this case. The plaintiffs instituted an action against the widow and creditors of T. C. Leak, deceased, for the purpose of securing an order to sell property to create assets and to settle the estate. After the cause had been committed to a referee, the Title Guaranty and Insurance Company and the Louisville Title Company filed a petition before the referee.
