Petitioner pleaded guilty to an information charging him with rape, a felony. His motion for probation was granted, and he was placed on five years’ probation on the condition that he serve two years in the county jail. After having served one year and three months of this period, he filed this petition for habeas corpus on the ground that any confinement in the county jail in excess of one year is void under the provisions of section 19a of the Penal Code.
