*1362Appeal from a judgment of the Cayuga County Court (Peter E. Corning, J.), rendered May 1, 2003. The judgment convicted defendant, upon a jury verdict, of murder in the second degree, robbery in the first degree (two counts), assault in the first degree and conspiracy in the fourth degree.

It is hereby ordered that the judgment so appealed from be and the same hereby is unanimously affirmed.
