Everette C. Phillips appeals from a decision of the Benefits Review Board (BRB) of the United States Department of Labor which affirmed the denial by an Administrative Law Judge (AU) of Phillips’ claim for benefits under the Federal Coal Mine Health and Safety Act of 1969, as amended, and the Black Lung Benefits Act, 30 U.S.C. § 901 et seq. For the reasons stated herein, we affirm.
