Petitioner Harold McCain appeals the United States Department of Labor *185(“DOL”) Benefits Review Board’s Decision and Order, affirming the Decision and Order on Remand of the Administrative Law Judge (“ALJ”), denying Petitioner’s claim for benefits filed under Title IV of the Federal Coal Mine Health & Safety Act, as amended, 30 U.S.C. §§ 901-945.
