Appellee instituted his suit in the trial court to recover damages alleged to have been sustained by him on account of certain personal injuries claimed to have been suffered through certain acts of negligence committed by appellant on July 16, 1919.

Appellee alleged in substance that on July 16, 1919, he was in the employ of Collins’ Drug Store. That the defendant at such time was engaged in the wholesale drug business, including the sale of drugs, chemicals, and sundries to the retail drug stores of the southwest.
