Defandant in error Charles Levias joined by his wife, Ella Levias, sued plaintiff in error, the Kirby Lumber Company, and John H. Kirby, to recover 160 acres of land, part of the James Gray survey in Newton County, and specially plead title under the statute of limitations of ten years. Defendant in error Mrs. S. N.
