The minor plaintiff James H. Latour (“Latour”), by his father and next friend James W. Latour, brought this action against the defendants Henry DeGroot, III, *352M.D. (“Dr. DeGroot”) and the Commonwealth of Massachusetts/University of Massachusetts Medical Center for damages incurred as a result of Dr. DeGroot’s allegedly negligent care and treatment of Latour.
