1. This is a medical malpractice action in which the plaintiff, Steven C. Litchfield (“plaintiff’), alleges that the defendant, Dr. James C. Bayley (“defendant”) was negligent in his treatment and care of the plaintiff who was a patient at the University of Massachusetts Memorial Medical Center. At the time of the alleged negligence, November 19, 1997, the defendant was an Associate Professor of Orthopedic Surgery and an attending physician in the Department of Orthopedics at the University of Massachusetts.
