The indictment in this case was returned at a special term of the circuit court of Lawrence county on January 20, 1931, called for the purpose of investigating the particular crime of which defendant and another are charged; the defendant received notice of the indictment January 22, 1931, at which time he made bond for his appearance in the sum of $2,000; about 2 o'clock p. m. of the following day defendant was rearrested and kept in jail at Moulton, Ala., until 2 p. m.
