Appeal from Blount Circuit Court. Heard before Hon. J. E. Blackwood. Felix Patton was convicted of murder and he appeals.

The defendant was convicted of murder in the first degree, and sentenced to the penitentiary for life.

(1, 2) There was no error in permitting the witness, May, to state' that the deceased was dead and “was killed in Blount county.’ This was but the statement of a fact, and was not the expression of an opinion.
