Plaintiff Pedro Roque, the father of Edward Roque and the administrator of his estate, brought suit on April 3, 2009 against the United States, raising wrongful death and survival claims under the Federal Tort Claims Act (“FTCA”), based on the Government’s alleged negligence resulting in the assault on and death of Edward Roque on September 2, 2005.
