CASTLE, Circuit Judge.
Karl Zysett, patentee, and New-Nel Kitchen Products Company, his licensee, sued Popeil Brothers, Inc., for infringement of Zysset Patent No. 2,782,826. A trial restricted to the issues of validity of the patent and its infringement resulted in a judgment for the plaintiffs entered in October 1958. Defendant’s appeals from that judgment, and from the District Court’s denial of a subsequent motion for relief therefrom on the basis of newly discovered evidence, were considered by this Court in Zysset v.
