Appellant, Tip Top Construction Corporation (“Tip Top”), appeals the Superior Court’s January 22,2014 Order denying *727its motion for a preliminary injunction. For the reasons that follow, we reverse and direct the Superior Court, on remand, to grant Tip Top’s motion.
I. BACKGROUND
