On March 7th, 1894, one Robert Comben, the intestate of the plaintiff in error, was employed by the defendant in error in working in its stone or rock quarry at Avondale, in the State of New Jersey, and whilst so working he was, by the operation of the machinery and appliances of the defendant in use in its quarry, thrown from a ledge of rock where he was working and killed.
