Plaintiff-Appellant Hamilton County Education Association (“HCEA”) is a voluntary association of employees of the Hamilton County Department of Education (“HCDE”). HCEA brought this lawsuit against its members’ employer, Defendant-Appellee Hamilton County Board of Education (“Board”), asserting two violations of the Tennessee Education Professional Negotiations Act (“EPNA”) and one violation of 42 U.S.C. § 1983 for infringing on HCEA’s First Amendment right of expressive association.
