This suit was brought in the district court of Ft. Bend county by plaintiff, Harling, against defendant, railway company, for personal injuries alleged to have been received by plaintiff in a collision of an automobile, in which plaintiff was riding, and one of defendant’s trains, at a railway and street crossing in the town of Richmond. Defendant’s only special plea was contributory negligence. The case was submitted to the-jury on special issues.
