NEILL, Associate Justice.

-This is an appeal from a judgment of $8625 recovered by appellee for personal injuries inflicted by the negligence of the appellant.

The undisputed evidence shows that on May 21, 1906, while appellee was a passenger on one of appellant’s street cars in the city of El Paso, the car collided with another car on the same track and he was thrown to the ground and seriously and permanently injured.
