CONOVER, Judge.

Defendants-Appellants Kokomo Medical Arts Building Partnership and Pioneer Savings and Loan Association (collectively, Ko-komo Medical) appeal the trial court’s judgment in favor of Plaintiff-Appellee William Hutchens and Associates (Hutchens).

We affirm in part and reverse in part.

Kokomo Medical raises the following restated issues:

1. whether Hutchens’ claim was barred by res judicata, and

2. whether the trial court erred in awarding attorney fees.
