STATEMENT OF THE CASE

The question presented is whether a mechanic’s hen takes priority over a mortgage where the mortgage was executed before, but not recorded until after, the date when the mechanic’s lienholder began to furnish labor and materials. Greyhound Financial Corporation appeals from the entry of partial summary judgment for R.L.C., Inc. in R.L.C.’s action to foreclose on its mechanic’s Ken on property owned by Terre Haute, Brazil & Eastern Railroad.
