As stated by the appellant, the statement and nature of this case is as follows:

This appeal involves a suit for personal injuries brought against appellant, defendant below, for personal injuries, pain and suffering, and lost earnings and earning capacity allegedly sustained by Charles W. Latham, Jr., as a result of an automobile collision which occurred January 26, 1967, at the intersection of Rosewood and East Yandell Streets in the City and County of El Paso, Texas.
