This is a damage suit. It was originally filed in the District Court of Nueces County, Texas, by Walter Carey against Pure Distributing Corporation, a corporation, and one H. S. Johnson. Trial in the district court, with the aid of a jury, resulted in a verdict and judgment for Carey- against both defendants for $3500.00. On appeal by the defendant to the Court of Civil Appeals at San Antonio, this judgment, as a whole, was reversed, and judgment rendered for the defendants. 97 S. W. (2d) 768.
