On January 9, 1992, the defendant, Ruben Perea, pled guilty to one count of conspiracy to possess and distribute cocaine and marijuana, in violation of 21 U.S.C. § 841(a)(1). The plea was conditioned on the defendant’s right to appeal the denial of his motion to suppress' evidence found in a duffel bag that had been placed by his accomplice in the trunk of a livery cab in which the defendant was a passenger.
