The plaintiff, Joseph Littman, owned a two-story brick flat-roofed building in Clearfield. The first floor was used for stores and the second floor for living apartments and offices. The offices and apartments had telephone service. The roof of the building had a skylight. The plaintiff claimed that at noon on October 29, 1930, he went on the roof of this building to examine possible leaks and that as he walked over to the skylight he tripped and fell on his right side and injured his right elbow and right shoulder.
