Appeal from District Court, Sanders County; Henry L. Myers, Judge. Action by James Davidson against D. O’Donnell, as justice of the peace in and for Thompson township, Sanders county, and the United States Fidelity & Guaranty Company. Judgment for plaintiff. Defendants appeal from an order denying them a new trial.

In May, 1906, appellant O’Donnell was a duly elected, qualified and acting justice of the peace in and for Thompson township, Sanders county, Montana; and at that time there was pending in the court of sueh justice of the peace an action wherein Alden B. Bailey was plaintiff, and James Davidson, this respondent, was defendant. Such proceedings were had in that action in the justice of the peace court that on May 17, 1906, Bailey recovered a judgment against Davidson, and Davidson, desiring to appeal therefrom to the district court, filed with the justice of the peace his notice of appeal,…
