Three questions are presented on certiora-ri: (1) Are prior inconsistent statements— imputed by Pat Malloy, Jr. [Malloy, Jr.] to Brian C. Howard [Howard] — admissible for impeachment of Howard’s in-court testimony? (2) Does Barbara Crussel’s [Crussel or plaintiff] failure to list Malloy, Jr. as a witness on the pretrial order prevent her from offering his testimony to attack Howard’s credibility? and (3) Is the trial court’s exclusion of Malloy, Jr.’s rebuttal testimony [to be used for impeachment] reversible error which offends the minimum standards of fairness commanded by…
