August 5, 1922, appellant while employed as a guard at the Idaho State Penitentiary, was struck on the head with a stone, by a convict, fracturing his skull, necessitating a decompression operation for the removal of a piece of his skull, and leaving an opening therein through which the pulsations from the brain could be felt. August 9, 1922, notice of the accident and claim for compensation was properly made and served upon the Idaho State Penitentiary, the employer, the State Insurance Fund, the insurance carrier, and filed with the Industrial Accident Board.
