HAWKINS, Judge.
— Appellant Appellant was convicted for the murder of J. C. Baldwin, his punishment being fixed at fifteen years confinement in the penitentiary.
It is urged that an error which calls for the reversal of the case was committed by the trial court in the refusal to permit the introduction of certain evidence hereinafter referred to. At the time it was offered by appellant the testimony already before the jury had established the following facts, or raised issues relative thereto.
