CHRISTIAN, Judge.

The offense is murder; the punishment confinement in the penitentiary for five years.

Appellant shot and killed Jim Mobley, Jr., the parties involved being negroes. Deceased and his wife, Lizzie Mobley, had been married about eleven months. Lizzie Mobley had a daughter about twenty years old. Appellant, a boy eighteen years of age, lived in the home of deceased. Deceased accused his wife of permitting her daughter and appellant to engage in improper relations.
