Plaintiff, Joseph DeMasi, brings this action pursuant to 42 U.S.C. § 1983 alleging that defendants violated his due process rights under the Fourteenth Amendment of the United States Constitution when they terminated his benefits under N.Y. Gen. Mun. Law § 207-c. Defendants, Joseph Benéfico (“Benéfico”), Richard Sling-erland (“Slingerland”) and the Village of Pelham, New York, (collectively “defendants”), move to dismiss plaintiffs claim pursuant to Fed.R.Civ.P. 12(b)(6) on the grounds that plaintiffs benefits were lawfully terminated and his due…
