Plaintiff, Jones, on November 9, 1944, filed a petition in the Circuit Court of Macon County, Missouri. On January 23, 1947, the trial court sustained defendants' motion to dismiss the petition. Plaintiff then filed a motion for new trial which was overruled and he appealed.
