On the afternoon of November 30, 1952, the Diesel tractor and tandem trailer of plaintiff came into collision with a locomotive engine of the defendant railroad company at a point where the road of said company crosses Iowa Primary Highway No. 2 near Farmington.

The tractor was being driven by Harold Haynes. Max Ruble, a defendant, was the engineer operating the locomotive. Plaintiff brought suit for the damage done to his tractor and trailer, hereinafter referred to as the truck, and the railroad company counterclaimed for damage to its engine and track.
