The primal issue on this appeal is whether the doctrine of res ipsa loquitur arose upon the facts and circumstances of the case.

STATEMENT OF THE CASE

On 14 July 1972 JOSEPH H. HICKS filed a declaration in the 'Circuit Court for Baltimore County whereby he instituted an action in tort against CHESAPEAKE AND POTOMAC TELEPHONE COMPANY OF MARYLAND (Telephone Co.) claiming $75,000 damages he suffered due to its negligence.
