Tbe plaintiff in error, hereinafter referred to as the defendant, was convicted of having possession of intoxicating liquor, and was sentenced to pay a fine of flOO and to be confined in tbe county jail for 60 days. To reverse tbe judgment the defendant appeals.

A number of errors are assigned and argued by tbe defendant, but tbe only ones it is deemed necessary to notice are the following :

“The court erred in permitting a deputy sheriff, who was called and testified as a witness in chief for the state, to summon extra talesmen to complete tbe jury after tbe regular panel bad been exhausted.
