This appeal is prosecuted from a conviction had in the district court of Roger Mills county, in which plaintiff in error, Dave Koontz, was found guilty of robbery. October 16, 1911, the court rendered judgment and he was sentenced to be imprisoned in the penitentiary for a period of 50 years.

The information on which plaintiff in error was tried and convicted, jointly charged Dave Koontz, Charley Koontz, and Hal Buie, alias R. F. Graham, with the crime of robbery, committed in Roger Mills county on the 19th day of November, 1910, by taking from the possession and immediate presence of H.…
